Your Rights as a Credit Card User in Brazil

Contact the issuer first

Report the problem to the card issuer's customer service (SAC) and keep the protocol number.

Contest in time

To dispute a card charge under the CDC, notify the card administrator at least 10 days before the bill's due date; you can then deduct the disputed amount and pay the rest.

Go to the ombudsman

If customer service doesn't solve it, escalate to the institution's ouvidoria.

Escalate outside the bank

Complain to the Banco Central (the institution must answer within 10 business days), your state Procon or consumidor.gov.br.

For scams, file a police report

The Banco Central recommends a Boletim de Ocorrência and contacting both the issuer and the card machine company.

My bank sent me a credit card I didn't ask for. Is that allowed?

No. Resolução BCB nº 96 forbids institutions from sending or activating a payment instrument without your express request or authorization, and the CDC treats sending unrequested products or services as an abusive practice.

Can my card limit be raised without my permission?

No. Since 1 July 2024, your prior agreement must be obtained for each increase you didn't request, and you must be told when it happens.

How long does the bank have to answer a complaint filed with the Banco Central?

The Banco Central forwards the complaint to the institution, which must answer you within 10 business days.

Can I stop paying a charge I'm disputing?

Under article 54-G of the CDC, if you notified the card administrator at least 10 days before the due date, you can deduct the disputed amount from the bill total and pay the rest while the dispute is resolved.
