Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PointsExplained website at pointsexplained.com ("the Site"), operated by PointsExplained ("we," "us," or "our").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site. We may update these Terms from time to time; continued use after changes constitutes acceptance.

You agree to use the Site only for lawful purposes. You must not:

• Use the Site in any way that violates applicable federal, provincial, state, or international law or regulation.
• Attempt to gain unauthorized access to any part of the Site, its servers, or any connected database.
• Use automated tools (bots, scrapers, crawlers) to access the Site in a manner that exceeds reasonable use, or in violation of our robots.txt.
• Interfere with or disrupt the Site, its servers, or networks connected to it.
• Impersonate PointsExplained, its staff, or any other person or entity.
• Reproduce, distribute, or commercially exploit our content without written permission (see Section 3).
• Manipulate or abuse any link, form, or tool on the Site.

We reserve the right to restrict access to the Site for any user who violates these terms, without prior notice.

All content on the Site, including but not limited to text, graphics, logos, icons, images, data compilations, scoring methodologies, point valuations, tools, and software, is the property of PointsExplained or its content suppliers and is protected by Canadian and international copyright, trademark, and intellectual property laws.

You may: Share links to our pages, quote brief excerpts with proper attribution (including a link back to the source page).

You may not: Reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit our content without our prior written consent.

The PointsExplained name, logo, and all related marks are trademarks of PointsExplained. Third-party product names, logos, and brands mentioned on the Site are property of their respective owners and are used for identification purposes only.

We are not licensed financial advisors, credit counselors, or investment advisors. Our rankings and recommendations are computed from our card catalogue as described in our methodology. They are not a personalized analysis of your financial situation.

Before making any financial decision, including applying for a credit card, you should:

• Consider your own financial circumstances, needs, and objectives.
• Read the full terms and conditions of any financial product directly from the issuing institution.
• Consult a qualified financial professional if you need personalized advice.

Credit card offers, rates, fees, rewards, and terms are set by the issuing banks and are subject to change at any time without notice. We make reasonable efforts to keep our information accurate but cannot guarantee it reflects the latest changes from issuers.

PointsExplained currently has no affiliate partnerships and receives no payment from card issuers or affiliate networks. Links to issuers go straight to the issuer's own website.

If that changes, links that can earn a commission will be disclosed on the pages that carry them and on our Affiliate Disclosure page before they go live.

To the maximum extent permitted by applicable law, PointsExplained and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities.
• Financial losses resulting from credit card applications, products, or decisions made based on our content.
• Errors or inaccuracies in card data, point valuations, or other information on the Site.
• Unauthorized access to or alteration of your data or transmissions.
• Service interruptions, bugs, or viruses transmitted through the Site.

The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liability, our liability shall be limited to the fullest extent permitted by applicable law. Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., liability for fraud, death, or personal injury caused by negligence).

When you use our quiz or other interactive tools, you may provide data such as spending amounts, goals, and preferences ("User Content").

User Content is used only to compute the result you asked for. The quiz does not store your answers on our servers.

You retain ownership of any personal data you submit, and your rights over that data are governed by our Privacy Policy.

The Site contains links to third-party websites, including those of banks, credit card issuers, and loyalty programs. These links are provided for your convenience and reference only.

We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites. Linking to a third-party site does not imply endorsement of that site. When you leave PointsExplained via an external link, you are subject to that site's terms and privacy policy.

You agree to indemnify, defend, and hold harmless PointsExplained, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or inability to use the Site.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Any User Content you submit.

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

For users in the European Union or United Kingdom: Nothing in these Terms affects your statutory rights as a consumer under mandatory local law, including the right to bring claims in your local courts.

For users in Brazil: Consumer protection provisions under the Código de Defesa do Consumidor apply where mandatory.

For users in Australia: Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy provided under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) to the extent it cannot be excluded.

If you have a dispute regarding the Site or these Terms, we encourage you to first contact us at legal@pointsexplained.com so we can attempt to resolve it informally.

If informal resolution is not successful within 30 days, the dispute shall be resolved by binding arbitration administered under the rules of the ADR Institute of Canada, conducted in English in Toronto, Ontario. The arbitrator's decision shall be final and binding.

Class action waiver: To the extent permitted by law, you agree that any claims shall be brought in your individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.

Exceptions: This arbitration clause does not apply to consumers in jurisdictions where mandatory law grants the right to bring claims in local courts (including the EU, UK, Australia, and Brazil).

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Site ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
